If you do not agree with any part of these terms, you are prohibited from using our services.
2. Description of Services
YouBuyChina acts strictly as a B2B and B2C sourcing advisor and procurement facilitator connecting international buyers with manufacturers. We provide factory verification, price negotiation, and physical quality inspection consulting services. We do not manufacture goods directly, nor do we operate as a traditional retail or dropshipping storefront.
3. Sourcing and Fulfillment Model
YouBuyChina.com acts as a global sourcing agent and facilitator. By utilizing our consulting services, you acknowledge and agree that we do not hold localized inventory or process the bulk capital for physical goods. Instead, we secure, inspect, and verify the products directly from partnered manufacturing facilities located in Asia on your behalf. All mass manufacturing and inventory payments are transacted directly between the client and the manufacturer (commonly utilizing secure third-party platforms like Alibaba).
4. Account Registration and Security
To access our buyer dashboard and submit sourcing requests, you must register an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
5. Payments, Pricing, and Fees
YouBuyChina operates on a "verify first, pay later" model. You are not required to make any financial commitment until our team has successfully located your requested product or supplier.
Once we verify the supplier and product, we charge specific advisory fees (such as our $60 Supplier Data Introduction fee, $150 Full Sourcing Management fee, percentage-based commissions, or custom branding/testing fees). These fees compensate our team for procurement, negotiation, and inspection services. All service fees are displayed transparently prior to checkout.
Payments made through the YouBuyChina.com platform and our integrated payment gateways are solely to compensate our team for these verified, ground-level sourcing services. You acknowledge that our advisory and sourcing request fees are distinct from the final manufacturing cost of your physical goods. We comply fully with Visa, Mastercard, and PCI DSS processing standards.
6. Intellectual Property and OEM Manufacturing
When utilizing our services for Original Equipment Manufacturing (OEM) or custom product designs, you retain all intellectual property rights to your provided blueprints, CAD files, and branding. YouBuyChina will facilitate the signing of NNN (Non-Disclosure, Non-Use, Non-Circumvention) agreements with Chinese factories on your behalf when requested. However, you acknowledge that YouBuyChina is not a law firm and does not guarantee the enforceability of these contracts under Chinese jurisdiction without the retention of independent legal counsel.
7. Product Quality, Warranties, and Alibaba Escrow
Before our final service fee is invoiced, our team will provide media verification (images and video) of the sourced goods or verify the supplier options based on your specifications. While we strive to identify all visible defects during physical inspection, our reports reflect the condition of the randomly sampled goods at the exact time of inspection.
YouBuyChina does not provide long-term product warranties or guarantees against latent defects that may appear post-delivery. However, because your bulk manufacturing payments are routed directly to the supplier via Alibaba Trade Assurance, your physical purchase is secured under their escrow policies. Any claims for damaged, missing, or defective physical goods must be filed directly through your Alibaba buyer dashboard as a Trade Assurance dispute.
8. Customs, Duties, and Import Regulations
The buyer acts as the Importer of Record. You are strictly responsible for ensuring that any products sourced or imported comply with the local laws, safety regulations, and import restrictions of your destination country. Unless a Delivered Duty Paid (DDP) shipping incoterm is explicitly agreed upon in writing with the factory, you assume full responsibility for all customs clearance, import taxes, tariffs, and port fees upon the arrival of the goods.
9. Prohibited Items and User Conduct
You agree not to use our platform to source, manufacture, or transport illegal, hazardous, counterfeit, or heavily restricted materials. This includes, but is not limited to, unauthorized branded merchandise (replicas), weapons, narcotics, and dangerous chemicals. We reserve the right to immediately terminate the account and forfeit the fees of any user attempting to source prohibited items.
10. Limitation of Liability
To the maximum extent permitted by applicable law, YouBuyChina and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Because we act as consultants and not manufacturers, we cannot be held liable for manufacturing delays caused by third-party factories, international ocean or air freight delays, acts of God, global pandemics, or customs seizures. Our maximum total liability for any advisory service provided is strictly limited to the amount paid directly to YouBuyChina for that specific service.
11. Indemnification
You agree to indemnify, defend, and hold harmless YouBuyChina, its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the platform, including, but not limited to, intellectual property infringement claims brought against the products you requested to be manufactured.
12. Dispute Resolution and Governing Law
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with standard international commercial law. Any disputes arising from these terms shall be resolved through binding arbitration or mediation, emphasizing fair and amicable resolutions for international trade participants, prior to seeking formal litigation.

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes constitutes acceptance of those changes.

Refund & Cancellation Policy

2. Unfulfilled Sourcing Requests
Payment for an initial sourcing request guarantees research for a maximum of 2 product specifications. If our on-ground team is entirely unable to locate a suitable manufacturer or an acceptable alternative for your specified product within 14 business days, you are entitled to a 100% full refund of your initial sourcing fee.
3. Physical Goods & Alibaba Trade Assurance
To provide our clients with maximum security, YouBuyChina routes bulk inventory and manufacturing payments directly between you and the supplier using secure B2B escrow platforms, primarily Alibaba Trade Assurance. We do not hold or process the capital for your physical goods.
Because of this, if a physical product arrives damaged, defective, or severely delayed, you are fully protected by Alibaba’s buyer protection policies. You can open a dispute directly on the Alibaba platform to request a refund from the factory for the physical goods.
While our YouBuyChina advisory and service fees remain strictly non-refundable, our team will actively assist you in gathering your pre-shipment inspection reports, media verification, and factory communications to strongly support your Alibaba Trade Assurance dispute and help you win your case against the manufacturer.
4. Shipping Timeframes & Logistics
While we assist in coordinating logistics with the factory, standard international transit times apply to all physical product orders shipped from Asia. By utilizing our services, you explicitly acknowledge that international logistics delays caused by customs clearance, port congestion, or severe weather are outside of our control and do not qualify for a refund of our consulting fees.
5. Chargebacks and Payment Disputes
We maintain comprehensive records of all media verification, client approvals, and physical inspection reports. In the event of a fraudulent chargeback or a payment dispute filed regarding our service fees, this policy and all corresponding verification data will be submitted to the payment gateway and the issuing bank to contest the dispute.

Return Shipping Location & Corporate Address
Please note that our corporate correspondence address listed below is a document processing hub, not a return warehouse. To return a physical item to the factory, you must contact customer support to get the authorized Return Merchandise Authorization (RMA) number and the correct factory return warehouse address. Sending items to our corporate hub without authorization will result in the package being rejected.
